This past year two of Penney and Associates injury lawyers, Larry Eslinger and Kevin Elder, tried a motorcycle accident case in Orange County against a large retail outlet. Plaintiff, a hairstylist, was traveling on the back of a motorcycle operated by her boyfriend and fiance. The two had left Reno, Nevada for a trip around South Lake Tahoe California. The two were traveling on State Route Highway 431 (Mount Rose Highway) enjoying their trip. The highway is a two-lane narrow mountain road with double, solid-yellow lines dividing the lanes.
At the same time, defendant driving a large ten ton construction supply truck, was stopped on the northboud shoulder of the highway, in the same direction plaintiff was traveling. The truck driver was lost and should have been traveling in the opposite direction. Clearly upset at being lost the truck driver made a rash decision and made an illegal U-turn across the double yellow lines directly in the path of plaintiff’s motorcycle.
Plaintiff and the operator of the motorcycle had to lay the motorcycle down to avoid an impact. Afer plaintiff exited the motorcycle she began sliding toward the truck. She observed the truck run over the operator of the motorcycle and then observed the left rear wheel of the truck run over her right hip. She suffered a small area fracture of the right hip. Fortuantely plaintiff healed well and made a nice recovery.
The jury awarded in excess of $775,000.00 in damages. The trucking company offerd $200,000 to settle the case before trial.
Though Penney and Associates cannot guarantee that your case (even if similar) will have the same results, it is important to note that insurance companies like to keep money and if you have been injured in an auto or motorcycle accident, call an injury attorney. In my experience the insurance company will do you no favors!
